§ 10Data protection
Information on the processing of your personal data can be found in our privacy policy (akceptum.ch/datenschutz).
§ II · Legal · Privacy
Privacy policy
We process personal data exclusively in accordance with the fully revised Swiss Data Protection Act (DSG, in force since 1 September 2023) and the Data Protection Ordinance (DSV) and — for data subjects in the EU or EEA — in accordance with the General Data Protection Regulation (GDPR).
§ 1Controller
§ 2EU representative (Art. 27 GDPR)
Akceptum AG is domiciled in Switzerland. Where processing falls within the scope of the GDPR and a representative in the Union is required under Art. 27 GDPR, Akceptum AG appoints such a representative. Lub System Sp. z o.o. (Poland) serves as the point of contact and representation structure within the EU. Data subjects in the EU/EEA may contact us at any time via [email protected]; their requests will, where necessary, be forwarded to the representative.
§ 3Principles
We process personal data lawfully, in good faith, proportionately and transparently, and only for the purpose stated at collection, provided for by law or evident from the circumstances (Art. 6 DSG; Art. 5 GDPR). We take appropriate technical and organisational measures to ensure the security of personal data (Art. 8 DSG; Art. 32 GDPR).
§ 4Legal bases and duty to inform
We inform data subjects about the collection of personal data (Art. 19 DSG; Art. 13 and 14 GDPR). Depending on the processing, we rely on the following legal bases: your consent (Art. 6 para. 6 DSG; Art. 6(1)(a) GDPR), the performance or initiation of a contract (Art. 6(1)(b) GDPR), a legal obligation (Art. 6(1)(c) GDPR) or an overriding legitimate interest (Art. 31 DSG as a justification; Art. 6(1)(f) GDPR).
§ 5Server logs and hosting
This website is delivered via Cloudflare Pages. When the site is accessed, technical information is processed to maintain operation and defend against attacks — in particular the IP address (in shortened form), date and time of the request, the URL accessed, the volume of data transferred, the HTTP status, the referrer and the user agent. This data is generally deleted after 14 days. The service provider is Cloudflare, Inc. (USA), which is certified under both the Swiss-US Data Privacy Framework and the EU-US Data Privacy Framework. Transfers to the USA are based, for disclosures from Switzerland, on the Swiss-US Data Privacy Framework and, for data subjects in the EU, on the EU-US Data Privacy Framework, supplemented by Standard Contractual Clauses. Legal basis: legitimate interest in the secure operation of the website (Art. 31 DSG; Art. 6(1)(f) GDPR).
§ 6Contact form
If you send us a message via the contact form, the data you enter (name, email address, company where applicable, message) is transmitted to our service provider Formspree, Inc. (United States), temporarily stored there and delivered to our email address. The data is used exclusively to handle your enquiry.
As Formspree is based in the USA, data is transferred to a third country. Protection is ensured through Standard Contractual Clauses and — where the provider is certified accordingly — through the Swiss-US and EU-US Data Privacy Framework. Legal basis: your consent (Art. 6 para. 6 DSG; Art. 6(1)(a) GDPR) and the legitimate interest in responding to your enquiry.
§ 7Appointment booking
Appointments are booked via Cal.com. When the booking page is accessed, Cal.com processes your input (name, email, preferred date) and, where applicable, technical metadata. Cal.com's privacy policy applies additionally.
§ 8Fonts
This website uses fonts from Bunny Fonts (BunnyWay d.o.o., Slovenia) — a privacy-friendly, GDPR-compliant mirror of the Google Fonts directory. Bunny Fonts sets no cookies and, according to its own statements, does not permanently log IP addresses.
§ 9Audience measurement
Where audience measurement is activated, we use Cloudflare Web Analytics. This tool works without cookies, without fingerprinting and without transferring personal data to a separate analytics platform. Only aggregated page views, referrers and user agents are recorded.
§ 10Processing on our behalf
We use carefully selected processors (in particular for hosting, form delivery and appointment booking) and contractually oblige them to comply with data protection in accordance with Art. 9 DSG and Art. 28 GDPR.
§ 11Retention
We retain personal data only for as long as is necessary for the respective processing purposes or as required by statutory retention obligations (e.g. the ten-year retention obligation for business records under Art. 958f CO). Thereafter the data is deleted or anonymised.
§ 12Disclosure to third parties
We treat personal data confidentially and only disclose it where you have consented, where we are legally obliged or entitled to do so, or where it is necessary to perform a contract. We do not sell personal data. Transfers to states without an adequate level of data protection take place only with appropriate safeguards (Standard Contractual Clauses; Swiss-US and EU-US Data Privacy Framework).
§ 13Your rights
You have the right of access (Art. 25 DSG; Art. 15 GDPR), to rectification, erasure and restriction of processing, as well as to data release and portability (Art. 28 DSG; Art. 20 GDPR). You may object to processing (Art. 21 GDPR) and withdraw consent at any time with effect for the future. You may also lodge a complaint with the competent supervisory authority — in Switzerland with the Federal Data Protection and Information Commissioner (FDPIC/EDÖB), and in the EU with the respective competent national supervisory authority.
§ 14Data protection contact
For data-protection matters, please write to [email protected] with the subject "Data protection".
§ III · Legal · Terms
Terms and conditions
These terms govern the relationship between Akceptum AG (Baar, Switzerland) and its commercial clients.
§ 1Scope
These general terms and conditions (hereinafter "Terms") apply to all contracts between Akceptum AG, Sihlbruggstrasse 105, 6340 Baar (Switzerland), hereinafter "Akceptum", and commercial clients ("Client"). Consumer contracts within the meaning of consumer law are not concluded.
Deviating or supplementary conditions of the Client apply only if Akceptum has expressly agreed to them in writing.
§ 2Services
Akceptum provides operational services in the disciplines of administration and law, localisation and translation, business analytics, process automation, AI agents, marketing and SEO, as well as IT and digital solutions.
The specific scope of services follows from the respective individual contract (offer, order confirmation, statement of work). Advisory services without a concrete deliverable are expressly not part of the standard offering.
§ 3Conclusion of contract
Offers from Akceptum are non-binding unless expressly designated as binding. A contract is concluded upon written order confirmation by Akceptum or upon the actual commencement of work.
§ 4Remuneration and payment
Remuneration is governed by the individual contract. Unless otherwise agreed, billing is based on time and effort at the applicable hourly rates. Any VAT due is shown additionally. Invoices are due for payment within 30 days without deduction.
In the event of late payment, default interest at the statutory rate applies (Art. 104 CO). Akceptum is entitled to withhold services in the event of late payment.
§ 5Client's duty to cooperate
The Client provides Akceptum with the information, documents and access required to render the services in good time and in full. Delays due to late cooperation are not to the detriment of Akceptum.
§ 6Confidentiality
Both contracting parties undertake to keep confidential information of the other party secret during and after the end of the contract and to use it only for the performance of the contract. This obligation continues indefinitely.
§ 7Data protection and processing
The parties comply with the applicable data-protection provisions (DSG, GDPR). Where Akceptum processes personal data on the Client's behalf in the course of rendering services, the parties conclude a data-processing agreement in accordance with Art. 9 DSG and Art. 28 GDPR.
§ 8Representation in the EU
For selected EU mandates, Akceptum has a representation structure through Lub System Sp. z o.o. (Poland), a member of the German-Polish Chamber of Industry and Commerce (AHK Poland). Lub System Sp. z o.o. acts as authorised representative of Akceptum AG within the EU, insofar as this is contractually agreed and required for the respective mandate.
All mandate relationships, invoices and liabilities remain with Akceptum AG, Baar, unless otherwise stipulated in the individual contract.
§ 9Intellectual property
For the work results created by Akceptum, the Client acquires, upon full payment of the agreed remuneration, the non-exclusive, non-transferable right of use for the contractually agreed purpose. Exceptions — in particular the transfer of exclusive rights — require a separate written agreement.
§ 10Liability
Akceptum is liable without limitation for intent and gross negligence. In the case of slight negligence, liability is limited to the foreseeable damage typical of the contract and, in amount, to the value of the relevant individual contract. Liability for lost profit and for indirect or consequential damages is excluded within the limits permitted by law.
§ 11Termination
Contracts of indefinite duration may be terminated by either party with 30 days' notice to the end of the month. The right to extraordinary termination for good cause remains reserved. Terminations require written form (email suffices).
§ 12Final provisions
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by a rule that comes closest to its economic purpose. The authoritative language is German; translations are provided for information only.
§ 13Governing law and jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Baar / Zug, Switzerland, unless mandatory statutory provisions stipulate another place of jurisdiction.
§ IV · Legal · Cookies
Cookie notice
akceptum.ch operates largely without cookies. This notice explains which small amounts of data we nevertheless use, when — and why.
§ 1What are cookies?
Cookies are small text files that a web server stores on your device in order to recognise you on your next visit. There are also similar technologies such as local storage and session storage, which are stored in the browser rather than on the server.
§ 2Cookies on akceptum.ch
akceptum.ch itself sets no tracking cookies. We use neither advertising networks nor conversion tracking. There is no cookie banner because no consent-requiring cookies are set.
§ 3Legal framework
Technically necessary cookies may be used without consent, provided you are informed about them and can refuse their use. The relevant provisions are, in Switzerland, Art. 45c lit. b of the Telecommunications Act (FMG) in conjunction with the DSG, and in the EU, Art. 5(3) of the ePrivacy Directive 2002/58/EC. For cookies that are not strictly necessary, explicit consent would be obtained; we do not use any such cookies.
§ 4Cloudflare
This website is delivered via Cloudflare. Cloudflare uses a technical cookie (__cf_bm) for bot detection and security. This cookie is necessary for secure operation and contains no personal profile information. Audience measurement — if active — is carried out via Cloudflare Web Analytics, which works without cookies and without fingerprinting.
§ 5Third-party providers
The following external services may set cookies or similar technologies when individual functions are used:
- Formspree — processing of the contact form. When the form is submitted, technical cookies are set for spam protection.
- Cal.com — booking system. When the booking page is accessed, Cal.com sets its own cookies for session management.
- Bunny Fonts — font delivery. According to its own statements, Bunny Fonts sets no cookies.
§ 6Managing cookies
You can display, block or delete cookies in your browser settings. The procedure differs depending on the browser; the relevant help pages of the browser providers explain the process in detail. Completely blocking all cookies may limit the functionality of this or other websites.
